Sorry for the bulk nature of this E-Mail, but as you will see, this is an important matter on which we have very little time to act.

There is currently a Bill before WA State Parliament proposed by Dr Janet Woollard, which has been amended in the last 24 hours which will effectively close Devlin’s stores in Subiaco and London Court.

Under the new amendments no tobacco products will be able to be displayed in any retail store, this means cigars will need to be away from view in locked boxes and may only be seen after they have been purchased. Previously we were protected from the display laws under section 23 of the tobacco control act which exempted specialist retailers like our selves, under this new amendment they will delete section 23 unless we urge our Members of Parliament to change this.

This bill is being debated and possibly voted upon tomorrow (Tuesday), so we must act now.

We are appealing to our Members of Parliament not to destroy a small business and see 8 people unemployed as an unintended consequence of Bill designed to protect minors from smoking.

Also in the bill they are proposing to ban smoking in any outdoor public area “that is provided as an area where food or drink may be consumed, whether or not on a commercial basis” this is basically any area outside your house or your car, most people are unaware of this new change. Yes that’s right you will no longer be able to smoke outside!

We must let everyone know to call or E-Mail their local member on Monday morning and demand this right not be taken away from us.

Please send this on to as many people as you see fit!

Below is a link for the list of Members of Parliament, please call or send an email telling them how you feel about this. I urge you to contact your local Member of Pariliament personally and explain what the deletion of section 23 will do. I have also attached a link with all of the MP's email addresses that you will be able to copy and paste into the Bcc section of your email.

I'm sorry to butt in, I don't live in Australia but I think this concerns everyone who loves cigars.

All of this BS is really getting carried away. Here in France It's the same. It may move a little

slower then elsewhere but we're getting there also. We have two cigar magazines that have been

stoped from publishing after a court trial sentence. They were attacked by the French wing of

" the defence for nonsmokers" who said that cigar magazines were making publicity for tobacco

products when they describe their cigar tasteings at cigar dinners, even when the evening was

marked "private night " . Clubs are in the same mess, Blogs are also being brought to trial

because they talk cigars and described what they smoked. A forum like FOH , in France, would

have gone to court a long time ago. Soon, everything will be forbidden, Food, drink, smoking,

Having fun, making love, walking, runing, stoping, Talking, looking, They want to protect us

so much that they are killing LIFE alltogether. this has got to STOP. :angry::angry:

such rubbish! I still can't believe that they won't allow exemptions for the non-smoking laws at cigar bar venues. Its getting rediculous. I am in Melbourne btw and if this happens here I will not be impressed.

laficion: I wasn't aware of this situation in France. Here in Singapore, the anti-smoking campaign is also in full-farce, but that's kinda expected from a country where attempting(or failure) to commit suicide would result in a jail term.

Unfortunately, I believe politicians are now appeasing the anti-smoking Nazis to the brink of almost automatically endorsing any ludicrous attempts at elevating their bloody pedestal, made from the flesh and bones of freedom sacrificed from honest, hardworking folk.

I smoke proud, and I will not be oppressed.

The witch hunt continues eh? Sorry for your troubles my Aussie BOTL, I too can relate to this insufferable set of circumstances. Not smoking in any outdoor venue though, geesh thats just ridiculous.

It will happen in melbourne as well eventually,maybe this bill wont pass but the devils at the door as to speak, we don;t have cigar bars here, against the Law

I Envy Our American brothers I hope they know how lucky they are to have proper cigar bars (lounges)....and from all accounts they don't seem to have a customs service either :o (or maybe cigars are just cigars to them :angry: ),but they are Cuba's gift to the world so matter how they get through enjoy :angry:

Good luck to Simon on this.

Local constituents need to get on board in relation to protesting the amendments. No doubt Simon also has legal advice on this. A court challenge may be on the horizon.

From my understanding of the laws in Victoria you can not smoke in an enclosed area even underground carparks are a no no. Cigar lounges included unless they have an open area to smoke.

I work at the casino in Melbourne. Fedels Gone awhile back now (smoking laws)... Smoking on the gaming floor gone. They have 2 smokers balconeys and one smokers lounge which is very ordinary to say the least. Only the high rollers room and a couple of other rooms are allowed smokers as they classify them as international rooms. State smoking laws no applicable..

They still have the cigar store Casa Del Oro but thats it. Now every other smoker goes out in the the weather to smoke.

Baranows in Hawthorn have a great little area to drink but no smoking please.

So it suxs but it has happened here already!! Maybe not as bad but its getting there:mad:

Especially the smaller business they really do suffer, I spose its welcome to being the minority :cigar:

I understand that the changes will not have the extreme affect on some small business that is being suggested.

This is really getting ridiculous! What's next? They going to tell me it's illegal to breathe because it's hazardous due to all the polution? Or that walking in the sunshine is illegal because it might cause skin cancer?

Anybody interested in chipping in to buy an island somewhere in the Pacific? You'll be free to smoke and drink all you want. The only law will be that Ken MUST wear pants....

There was an island in QLD for sale they wanted 3 million dollars .. if we all put 50 000 each thath's 60 members ... I say why not!

I appreciate the particular concerns you have raised in relation to this bill’s potential impact on Devlin’s Cigar Lounge.

I have spoken directly to Mr Simon Devlin about this issue and I am working closely with his representatives to ensure that common sense and effective amendments to the bill are considered. It is likely that an amendment will be made to this bill to allow the cigar shop to continue operating. This amendment is likely to be forwarded by the Government following negotiation with the Opposition and Independents.

Labor is considering a range of other amendments to improve the bill – many of these amendments were suggested by the Parliamentary Health and Education Committee’s detailed report on this bill. A copy of their report into this bill is available from the Parliament website at:

As you would be aware, there is still further some debate to clarify issues around smoking in outdoor eating and drinking areas. Although I'm glad that some compromise is being sorted out, I just feel that BOTLs around the world are being systematically persecuted, with us having to beg for the tiniest bit of liberty to enjoy a luxury that has existed for centuries. And to be delighted with it. :cigar:
