It was slipped into a 35 page bill that in all honesty, was probably not read in its entirety by many. I would not be surprised to see this addressed during the next session (January). Our state Comptroller has committed quite an overstep with this one.
cigcars Posted May 13, 2011 Posted May 13, 2011 *WHEW!! Glad I don't live in that state!! Kentucky is a tobacco growers, burley and cigarette 'n chaw type of chew producin' state! The state has consistently fought off many, if not all attempts to stave it off or reduce it's usage. It's many people's here's lifeblood...Thank God!

anacostiakat Posted May 13, 2011 Posted May 13, 2011 My understanding is that there has been an outpouring of complaints sent to the comptrollers office (and others) and that this will be addressed in the next session. Keeping my finghaz crossed for my Maryland brothers and sisters.

There are already several names, Republican and Democrat, who've stated they'd either sponsor or co-sponsor this bill.

In a country of abundance, the states now seek ways to self impose restrictions in an effort to gain tarrifs and generate revenue, and of course, the people always pay a premium. Remember, states are like small countries, and the Feds are the overlords. Another great day for the working Joe in the USSR opps USA

Peter11216 Posted May 15, 2011 Posted May 15, 2011 In this case the solution is at the Federal level. The Constitution forbids states from regulating interstate commerce. It's got to be a funny situation for anyone who is pro-"states rights" and also wants to mail order cigars. One the one hand, Maryland should be able to do what it wants, right? On the other, Maryland should be restricted by the Federal Government, acting with Constitutional authority, to prevent it from regulating mail order cigars. If you go on to read the article, it points out that some shop owners favor the ban, since they feel they are undercut by internet sellers. Shouldn't Maryland be able to protect its business owners without the Federal Government getting in the way. But cigar buyers want the Federal Constitution to trump state law, so that they can order from out of state. Could all be for naught, anyways. According to the article, "[The comptroller] Franchot is working with legislators to change the law so premium cigars could be ordered on the Web — so long as the tax collection is assured, Shapiro said Friday." They weren't planning to get in the way of certain cigar smokers, "Rather, [[The comptroller] Franchot] said, it was aimed at contraband cheap cigars and "these cigar aficionados kind of got caught up in this. … We weren't thinking of the cigar-of-the-month person."" So, in fact, no big deal. This is truly sad.
