Denver, Colorado’s Flavored Tobacco Ban Now in Effect

As 2026 kicked off, so did the enforcement of Denver’s new ban on flavored tobacco products, which voters approved in the November election by way of a nearly 72 percent approval rate.

The ban was originally approved in December 2024 by an 11-1 vote of the Denver City Council and took effect on March 18, 2025. However a coalition of vape stores began a signature-gathering campaign to get the issue on the ballot so that voters could have the ultimate say, collecting approximately 17,000 signatures in order to meet the requirement of 9,494 signatures to qualify for the ballot. Once certified, the ban was placed on the election as Referendum 310, with voters being asked whether to keep it in place or repeal it.

The ban applies to the sale of almost all forms of flavored tobacco, including cigars, pipe tobacco, and flavored vaping products. However, it does not apply to flavored tobacco intended to be smoked in a hookah that is sold at a hookah tobacco retailer. It also did not make it illegal to possess or use a flavored tobacco product.

Retailers who violate the new law will face suspensions of their privilege to sell tobacco products should they receive two or more violations within a one-year window. Suspensions start at a minimum of 30 days and increase to a year for four or more violations. Additionally, that window will expand in the coming years; as of January 1, 2027, two violations within a two-year period will result in a 30-day suspension.

Sounds like when California made it illegal for all favored vapes, besides tobacco flavor, but in my mind, tobacco is a flavor. Doesn't make sense.
